These Terms and Conditions ("Terms") govern your access to and use of the DunyaCity website, mobile app, and services (collectively, the "Service" or "Platform") provided by DunyaCity ("we", "our", "us"). By accessing or using our Platform, you ("you", "user", "customer") agree to comply with and be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part of these Terms, do not use our Platform.

1. General Terms

1.1 Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

1.2 Account Registration

To use certain features of the Platform (such as making bookings or managing properties), you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up to date.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately if you suspect any unauthorized access or use of your account.

2. Bookings and Payments

2.1 Booking Process

By using the Platform, you can book hotels, apartments, or other accommodations listed by property owners. All bookings are subject to availability and the terms set by the property owners.

2.2 Payment Terms

When you book through DunyaCity, you agree to pay the amount specified for the accommodation, including any applicable taxes, fees, and charges. Payments are processed through third-party payment providers. DunyaCity is not responsible for any issues related to payment processing.

2.3 Booking Confirmation

Once your payment is processed, you will receive a booking confirmation email. Your reservation will be confirmed upon successful payment, subject to the property owner's acceptance.

2.4 Cancellation and Refund Policy

Each property may have its own cancellation policy, which will be clearly indicated at the time of booking. You are responsible for reviewing the cancellation policy before confirming your booking. DunyaCity does not guarantee refunds unless stipulated in the property owner's cancellation policy.

3. User Conduct

3.1 Prohibited Activities

You agree not to engage in any of the following activities while using the Platform:

• Violate any applicable law, regulation, or third-party right.
• Attempt to interfere with, disrupt, or hack into the Platform's operation.
• Use the Platform for fraudulent or unlawful purposes.
• Post, upload, or transmit harmful, offensive, or illegal content, including but not limited to spam, viruses, or hate speech.
• Impersonate any person or entity or falsely represent your affiliation with any person or entity.

3.2 Reviews and Feedback

You may have the opportunity to leave reviews or feedback regarding your stay at a property. By submitting a review, you grant DunyaCity the right to use, publish, and display your review on the Platform. Reviews must be truthful, respectful, and comply with our community guidelines.

4. Intellectual Property

4.1 Platform Content

All content on the Platform, including text, images, logos, graphics, and software, is the property of DunyaCity or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any content from the Platform without our prior written consent.

4.2 User-Generated Content

By posting or submitting content (e.g., reviews, photos, or comments) to the Platform, you grant DunyaCity a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, and distribute that content across our Platform and related marketing channels.

5. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy for more details on how we handle your data.

6. Disclaimers and Limitation of Liability

6.1 No Warranty

DunyaCity does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components (such as viruses or malware). The Platform is provided "as is" and "as available," without any warranties or guarantees of any kind.

6.2 Limitation of Liability

To the fullest extent permitted by law, DunyaCity and its affiliates, officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

6.3 Property Owner's Responsibility

DunyaCity is not responsible for the accuracy, quality, or legality of any property listings, descriptions, or content posted by property owners. Property owners are solely responsible for the accuracy of the information they provide and for the condition of the accommodations.

7. Indemnification

You agree to indemnify and hold harmless DunyaCity, its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Platform, violation of these Terms, or violation of any third-party rights.

8. Termination

DunyaCity reserves the right to suspend or terminate your account or access to the Platform at any time, with or without notice, if we believe you have violated these Terms or for any other reason.

9. Governing Law and Dispute Resolution

9.1 Governing Law

These Terms will be governed by and construed in accordance with the laws of Azerbaijan, without regard to its conflict of law principles.

9.2 Dispute Resolution

Any dispute arising out of or related to these Terms shall be resolved through amicable negotiations. If the dispute cannot be resolved through negotiations, it shall be submitted to the appropriate courts in Azerbaijan.
